第一條 為了確立中國(guó)人民銀行的地位和職責(zé)，保證國(guó)家貨幣政策的正確制定和執(zhí)行，建立和完善中央銀行宏觀調(diào)控體系，加強(qiáng)對(duì)金融業(yè)的監(jiān)督管理，制定本法。
Article 1 This Law is enacted in order to define the status and functions of the People's Bank of China, ensure the correct formulation and implementation of the State's monetary policies, establish and perfect a macro-control system through a central bank and strengthen supervision and control over the banking industry.

第二條 中國(guó)人民銀行是中華人民共和國(guó)的中央銀行。
Article 2 The People's Bank of China is the central bank of the People's Republic of China.

中國(guó)人民銀行在國(guó)務(wù)院領(lǐng)導(dǎo)下，制定和實(shí)施貨幣政策，對(duì)金融業(yè)實(shí)施監(jiān)督管理。
The People's Bank of China shall, under the leadership of the State Council, formulate and implement monetary policies and exercise supervision and control over the banking industry.

第三條 貨幣政策目標(biāo)是保持貨幣幣值的穩(wěn)定，并以此促進(jìn)經(jīng)濟(jì)增長(zhǎng)。
Article 3 The aim of monetary policies shall be to maintain the stability of the value of the currency and thereby promote economic growth.

第四條 中國(guó)人民銀行履行下列職責(zé)：
Article 4 The People's Bank of China shall perform the following functions:

（一）依法制定和執(zhí)行貨幣政策；
(1) to formulate and implement monetary policies in accordance with law;

（二）發(fā)行人民幣，管理人民幣流通；
(2)to issue Renminbi(RMB) and control its circulation;

（三）按照規(guī)定審批、監(jiān)督管理金融機(jī)構(gòu)；
(3)to examine, grant approval to, supervise and administer banking institutions in accordance with regulations;

（四）按照規(guī)定監(jiān)督管理金融市場(chǎng)；
(4)to supervise and control the financial market in accordance with regulations;

（五）發(fā)布有關(guān)金融監(jiān)督管理和業(yè)務(wù)的命令和規(guī)章；
(5)to promulgate orders, rules and regulations concerning financial supervision and control and business operation;

（六）持有、管理、經(jīng)營(yíng)國(guó)家外匯儲(chǔ)備、黃金儲(chǔ)備；
(6)to hold,administer and manage the State foreign exchange reserve and gold reserve;

（七）經(jīng)理國(guó)庫(kù)；
(7)to manage the State Treasury;

（八）維護(hù)支付、清算系統(tǒng)的正常運(yùn)行；
(8)to maintain the normal operation of the systems for making payments and settling accounts;

（九）負(fù)責(zé)金融業(yè)的統(tǒng)計(jì)、調(diào)查、分析和預(yù)測(cè)；
(9)to be responsible for statistics, investigation, analysis and forecasting concerning the banking industry;

（十）作為國(guó)家的中央銀行，從事有關(guān)的國(guó)際金融活動(dòng)；
(10)to engage in relevant international banking operations in its capacity as the central bank of the State; and

（十一）國(guó)務(wù)院規(guī)定的其他職責(zé)。
(11)other functions prescribed by the State Council.

中國(guó)人民銀行為執(zhí)行貨幣政策，可以依照本法第四章的有關(guān)規(guī)定從事金融業(yè)務(wù)活動(dòng)。
To implement monetary policies, the People's Bank of China may carry out financial operations in accordance with the relevant provisions of Chapter ￠?? this Law.

第五條 中國(guó)人民銀行就年度貨幣供應(yīng)量、利率、匯率和國(guó)務(wù)院規(guī)定的其他重要事項(xiàng)作出的決定，報(bào)國(guó)務(wù)院批準(zhǔn)后執(zhí)行。
Article 5 The People's Bank of China shall report its decisions to the State Council for approval concerning the annual money supply, interest rates, foreign exchange rates and other important matters specified by the State Council before they are implemented.

中國(guó)人民銀行就前款規(guī)定以外的其他有關(guān)貨幣政策事項(xiàng)作出決定后，即予執(zhí)行，并報(bào)國(guó)務(wù)院備案。
The People's Bank of China shall immediately implement the decisions on monetary policies for matters other than those specified in the preceding paragraph and report them to the State Council for the record.

第六條 中國(guó)人民銀行應(yīng)當(dāng)向全國(guó)人民代表大會(huì)常務(wù)委員會(huì)提出有關(guān)貨幣政策情況和金融監(jiān)督管理情況的工作報(bào)告。
Article 6 The People's Bank of China shall submit a work report to the Standing Committee of the National People's Congress concerning matters relating to monetary policies and financial supervision and control.

第七條 中國(guó)人民銀行在國(guó)務(wù)院領(lǐng)導(dǎo)下依法獨(dú)立執(zhí)行貨幣政策，履行職責(zé)，開(kāi)展業(yè)務(wù)，不受地方政府、各級(jí)政府部門(mén)、社會(huì)團(tuán)體和個(gè)人的干涉。
Article 7 The People's Bank of China shall, under the leadership of the State Council, implement monetary policies, perform its functions and carry out its business operations independently according to law and be free from intervention by local governments, government departments at various levels, public organizations or individuals.

第八條 中國(guó)人民銀行的全部資本由國(guó)家出資，屬于國(guó)家所有。
Article 8 Al capital of the People's Bank of China is invested by the State and owned by the State.

第二章 組織機(jī)構(gòu)
Chapter￠??ganizational Structure

第九條 中國(guó)人民銀行設(shè)行長(zhǎng)一人，副行長(zhǎng)若干人。
Article 9 The People's Bank of China shall have a Governor and a certain number of Deputy Governors.

中國(guó)人民銀行行長(zhǎng)的人選，根據(jù)國(guó)務(wù)院總理的提名，由全國(guó)人民代表大會(huì)決定；全國(guó)人民代表大會(huì)閉會(huì)期間，由全國(guó)人民代表大會(huì)常務(wù)委員會(huì)決定，由中華人民共和國(guó)主席任免。中國(guó)人民銀行副行長(zhǎng)由國(guó)務(wù)院總理任免。
The candidate for the Governor of the People's Bank of China shall be nominated by the Premier of the State Council and decided by the National People's Congress; when the National People's Congress is not in session, the Governor shall be decided by the Standing Committee of the National People's Congress and appointed or removed by the President of the People's Republic of China. The Deputy Governors of the People's Bank of China shall be appointed or removed by the Premier of the State Council.

第十條 中國(guó)人民銀行實(shí)行行長(zhǎng)負(fù)責(zé)制。行長(zhǎng)領(lǐng)導(dǎo)中國(guó)人民銀行的工作，副行長(zhǎng)協(xié)助行長(zhǎng)工作。
Article 10 The People's Bank of China shall practise a system wherein the Governor shall assume overall responsibility. The Governor shall direct the work of The People's Bank of China, the Deputy Governors shall assist the Governor in his or her work.

第十一條 中國(guó)人民銀行設(shè)立貨幣政策委員會(huì)。貨幣政策委員會(huì)的職責(zé)、組成和工作程序，由國(guó)務(wù)院規(guī)定，報(bào)全國(guó)人民代表大會(huì)常務(wù)委員會(huì)備案。
Article 11 The people's Bank of China shall establish a monetary policy committee, whose functions, composition and working procedures shall be prescribed by the State Council and reported to the Standing Committee of the National People's Congress for the record.

第十二條 中國(guó)人民銀行根據(jù)履行職責(zé)的需要設(shè)立分支機(jī)構(gòu)，作為中國(guó)人民銀行的派出機(jī)構(gòu)。中國(guó)人民銀行對(duì)分支機(jī)構(gòu)實(shí)行集中統(tǒng)一領(lǐng)導(dǎo)和管理。
Article 12 The People's Bank of China shall establish branches as its representative organs in light of the need of performing its functions and exercise centralized and unified leadership and administration with respect to its branches.

中國(guó)人民銀行的分支機(jī)構(gòu)根據(jù)中國(guó)人民銀行的授權(quán)，負(fù)責(zé)本轄區(qū)的金融監(jiān)督管理，承辦有關(guān)業(yè)務(wù)。
The branches of The People's Bank of China shall, as authorized by The People's Bank of China, be responsible for financial supervision and control and handling of relevant business operations in their respective districts.

第十三條 中國(guó)人民銀行的行長(zhǎng)、副行長(zhǎng)及其他工作人員應(yīng)當(dāng)恪盡職守，不得濫用職權(quán)、徇私舞弊，不得在任何金融機(jī)構(gòu)、企業(yè)、基金會(huì)兼職。
Article 13 The Governor, Deputy Governors and other staff members of The People's Bank of China shall scrupulously abide by their duties; they may not abuse their power or conduct malpractice for private ends and they may not assume concurrent position in any other banking institutions, enterprises or foundations.

第十四條 中國(guó)人民銀行的行長(zhǎng)、副行長(zhǎng)及其他工作人員，應(yīng)當(dāng)依法保守國(guó)家秘密，并有責(zé)任為其監(jiān)督管理的金融機(jī)構(gòu)及有關(guān)當(dāng)事人保守秘密。
Article 14 The Governor, Deputy Governors and other staff members of People's Bank of China shall safeguard State secrets according to law and be obligated to safeguard the secrets of the banking institutions and parties concerned under their supervision and control.

第十五條 中華人民共和國(guó)的法定貨幣是人民幣。
Article 15 The legal tender of The People's Republic of China is the Reminbi(RMB).

以人民幣支付中華人民共和國(guó)境內(nèi)的一切公共的和私人的債務(wù)，任何單位和個(gè)人不得拒收。
When the Renminbi is used to repay all public or private debts within the territory of the People's Republic of China, no units or individuals may refuse to accept it.

第十六條 人民幣的單位為元，人民幣輔幣單位為角、分。
Article 16 The unit of the Renminbi is the yuan and the units of the fractional currency of the Renminbi are the jiao and the fen.

第十七條 人民幣由中國(guó)人民銀行統(tǒng)一印制、發(fā)行。
Article 17 The Renminbi shall be printed and issued solely by the People's Bank of China.

中國(guó)人民銀行發(fā)行新版人民幣，應(yīng)當(dāng)將發(fā)行時(shí)間、面額、圖案、式樣、規(guī)格予以公告。
When putting forth a new Renminbi issue, The People's Bank of China shall make known to the public the issuing date, face values, designs, patterns and specifications.

第十八條 禁止偽造、變?cè)烊嗣駧拧?
Article 18 It is prohibited to counterfeit or alter Renminbi.

禁止出售、購(gòu)買(mǎi)偽造、變?cè)斓娜嗣駧拧?
It is prohibited to sell or purchase counterfeit or altered Renminbi.

禁止運(yùn)輸、持有、使用偽造、變?cè)斓娜嗣駧拧?
It is prohibited to transport, hold or use counterfeit or altered Renminbi.

禁止故意毀損人民幣。
It is prohibited to deliberately destroy or damage the Renminbi.

禁止在宣傳品、出版物或者其他商品上非法使用人民幣圖樣。
It is prohibited to illegally use the patterns of Renminbi in propaganda materials, publications or other commodities.

第十九條 任何單位和個(gè)人不得印制、發(fā)售代幣票券，以代替人民幣在市場(chǎng)上流通。
Article 19 No units or individuals may print or sell promissory notes as substitutes for Renminbi to circulate on the market.

第二十條 殘缺、污損的人民幣，按照中國(guó)人民銀行的規(guī)定兌換，并由中國(guó)人民銀行負(fù)責(zé)收回、銷(xiāo)毀。
Article 20 The damaged or soiled Renminbi shall be exchanged in accordance with the regulations of The People's Bank of China, which shall also be responsible to recall and destroy such Renminbi.

第二十一條 中國(guó)人民銀行設(shè)立人民幣發(fā)行庫(kù)，在其分支機(jī)構(gòu)設(shè)立分支庫(kù)。
Article 21 The People's Bank of China shall establish a Renminbi issue treasury and shall establish subsidiary issue treasuries at its branches.

分支庫(kù)調(diào)撥人民幣發(fā)行基金，應(yīng)當(dāng)按照上級(jí)庫(kù)的調(diào)撥命令辦理。
The subsidiary issue treasuries shall, in allocating Renminbi issue fund, act on the order of allocation from their superior treasury.

任何單位和個(gè)人不得違反規(guī)定，動(dòng)用發(fā)行基金。
No units or individuals may use the issue fund in violation of regulations.

第二十二條 中國(guó)人民銀行為執(zhí)行貨幣政策，可以運(yùn)用下列貨幣政策工具：
Article 22 To implement monetary policies, The People's Bank of China may apply the following monetary policy instruments:

（一）要求金融機(jī)構(gòu)按照規(guī)定的比例交存存款準(zhǔn)備金；
(1)to require a banking institution to place a deposit reserve at a prescribed ratio;

（二）確定中央銀行基準(zhǔn)利率；
(2)to fix the base interest rates for the central bank;

（三）為在中國(guó)人民銀行開(kāi)立帳戶(hù)的金融機(jī)構(gòu)辦理再貼現(xiàn)；
(3)to handle rediscount for baking Institutions that have opened accounts in The People's Bank of China;

（四）向商業(yè)銀行提供貸款；
(4)to provide loans for commercial banks;

（五）在公開(kāi)市場(chǎng)上買(mǎi)賣(mài)國(guó)債和其他政府債券及外匯；
(5)to deal in State bonds and other government bonds and foreign exchange on the open market; and

（六）國(guó)務(wù)院確定的其他貨幣政策工具。
(6)other monetary policy instrument decided by the State Council.

中國(guó)人民銀行為執(zhí)行貨幣政策，運(yùn)用前款所列貨幣政策工具時(shí)，可以規(guī)定具體的條件和程序。
When applying the monetary policy instruments listed in the preceding paragraph to implement monetary policies, The People's Bank of China may work out specific requirements and procedures.

第二十三條 中國(guó)人民銀行依照法律、行政法規(guī)的規(guī)定經(jīng)理國(guó)庫(kù)。
Article 23 The People's Bank of China shall manage the State treasury in accordance with laws and administrative rules and regulations.

第二十四條 中國(guó)人民銀行可以代理國(guó)務(wù)院財(cái)政部門(mén)向各金融機(jī)構(gòu)組織發(fā)行、兌付國(guó)債和其他政府債券。
Article 24 The People's Bank of China may, on behalf of the financial department under the State Council, issue to banking institutions, and honour State bonds and other government bonds.

第二十五條 中國(guó)人民銀行可以根據(jù)需要，為金融機(jī)構(gòu)開(kāi)立帳戶(hù)，但不得對(duì)金融機(jī)構(gòu)的帳戶(hù)透支。
Article 25 The People's Bank of China may open accounts for banking institution as needed, but may not allow them to overdraw.

第二十六條 中國(guó)人民銀行應(yīng)當(dāng)組織或者協(xié)助組織金融機(jī)構(gòu)相互之間的清算系統(tǒng)，協(xié)調(diào)金融機(jī)構(gòu)相互之間的清算事項(xiàng)，提供清算服務(wù)。具體辦法由中國(guó)人民銀行規(guī)定。
Article 26 The People's Bank of China shall organize or assist in organizing a clearing system among banking institutions, coordinate the efforts of the financial institutions in matters of clearing and provide services in this regard. The specific measures therefor shall be formulated by The People's Bank of China.

第二十七條 中國(guó)人民銀行根據(jù)執(zhí)行貨幣政策的需要，可以決定對(duì)商業(yè)銀行貸款的數(shù)額、期限、利率和方式，但貸款的期限不得超過(guò)一年。
Article 27 The People's Bank of China may, as required by the implementation of monetary policies, determine the amounts, term, interest rates and forms of loans extended to commercial banks, however, the maximum term of loans shall not exceed one year.

第二十八條 中國(guó)人民銀行不得對(duì)政府財(cái)政透支，不得直接認(rèn)購(gòu)、包銷(xiāo)國(guó)債和其他政府債券。
Article 28 The People's Bank of China may not make an overdraft for the government, and may not directly subscribe or underwrite State bonds or other government bonds.

第二十九條 中國(guó)人民銀行不得向地方政府、各級(jí)政府部門(mén)提供貸款，不得向非銀行金融機(jī)構(gòu)以及其他單位和個(gè)人提供貸款，但國(guó)務(wù)院決定中國(guó)人民銀行可以向特定的非銀行金融機(jī)構(gòu)提供貸款的除外。
Article 29 The People's Bank of China may not provide loans to the local governments or government departments at various levels, to non-banking institutions, other units or individuals, with the exception of the specific non-banking institutions as decided by the State Council.

中國(guó)人民銀行不得向任何單位和個(gè)人提供擔(dān)保。
The People's Bank of China may not provide guaranty for any unit or individual.

第三十條 中國(guó)人民銀行依法對(duì)金融機(jī)構(gòu)及其業(yè)務(wù)實(shí)施監(jiān)督管理，維護(hù)金融業(yè)的合法、穩(wěn)健運(yùn)行。
Article 30 The People's Bank of China shall, in accordance with law, exercise supervision and control over banking institutions and their business operations to maintain the legitimate, stable and sound operation of the banking industry.

第三十一條 中國(guó)人民銀行按照規(guī)定審批金融機(jī)構(gòu)的設(shè)立、變更、終止及其業(yè)務(wù)范圍。
Article 31 The People's Bank of China shall, in accordance with regulations, examine and approve the establishment, modification and termination of banking institutions, as well as the scope of their business operations.

第三十二條 中國(guó)人民銀行有權(quán)對(duì)金融機(jī)構(gòu)的存款、貸款、結(jié)算、呆帳等情況隨時(shí)進(jìn)行稽核、檢查監(jiān)督。
Article 32 The People's Bank of China shall have the power to examine, inspect and supervise at any time the deposits, loans, settlements, bad accounts, etc. Of banking institutions.

中國(guó)人民銀行有權(quán)對(duì)金融機(jī)構(gòu)違反規(guī)定提高或者降低存款利率、貸款利率的行為進(jìn)行檢查監(jiān)督。
The People's Bank of China shall have the power to inspect and supervise banking institutions as to whether they raise or lower the interest rates on deposits or loans in violation of regulations.

第三十三條 中國(guó)人民銀行有權(quán)要求金融機(jī)構(gòu)按照規(guī)定報(bào)送資產(chǎn)負(fù)債表、損益表以及其他財(cái)務(wù)會(huì)計(jì)報(bào)表和資料。
Article 33 The People's Bank of China shall have the power to demand banking institutions to submit according to regulations balance sheets of their assets, statements of profit and loss and other financial and accounting reports and data.

第三十四條 中國(guó)人民銀行負(fù)責(zé)統(tǒng)一編制全國(guó)金融統(tǒng)計(jì)數(shù)據(jù)、報(bào)表，并按照國(guó)家有關(guān)規(guī)定予以公布。
Article 34 The People's Bank of China shall be responsible for compiling unified statistics and accounting statements from the national banking system and shall publish them in accordance with relevant regulations of the State.

第三十五條 中國(guó)人民銀行對(duì)國(guó)家政策性銀行的金融業(yè)務(wù)，進(jìn)行指導(dǎo)和監(jiān)督。
Article 35 The People's Bank of China shall guide and supervise the business operations of the policy-oriented banks of the State.

第三十六條 中國(guó)人民銀行應(yīng)當(dāng)建立、健全本系統(tǒng)的稽核、檢查制度，加強(qiáng)內(nèi)部的監(jiān)督管理。
Article 36 The People's Bank of China shall establish and perfect systems for its own examination and inspection and strengthen its own supervision and administration.

第六章 財(cái)務(wù)會(huì)計(jì)
Chapter￠??nancial Affairs and Accounting

第三十七條 中國(guó)人民銀行實(shí)行獨(dú)立的財(cái)務(wù)預(yù)算管理制度。
Article 37 The People's Bank of China shall exercise independent control over its financial budget.

中國(guó)人民銀行的預(yù)算經(jīng)國(guó)務(wù)院財(cái)政部門(mén)審核后，納入中央預(yù)算，接受?chē)?guó)務(wù)院財(cái)政部門(mén)的預(yù)算執(zhí)行監(jiān)督。
The budget of The People's Bank of China shall be incorporated in the central budget after it has been examined and verified by the financial department under the State Council and the implementation thereof shall be subject to supervision of the financial department under the State Council.

第三十八條 中國(guó)人民銀行每一會(huì)計(jì)年度的收入減除該年度支出，并按照國(guó)務(wù)院財(cái)政部門(mén)核定的比例提取總準(zhǔn)備金后的凈利潤(rùn)，全部上繳中央財(cái)政。
Article 38 The People's Bank of China shall, after withdrawing funds for its general reserve at a proportion determined by the financial department under the State Council, turn over to the State treasury the entire net profit remaining from its income in an accounting year minus its expenditures in the same period.

中國(guó)人民銀行的虧損由中央財(cái)政撥款彌補(bǔ)。
Losses sustained by The People's Bank of China shall be made up by appropriations from the State treasury.

第三十九條 中國(guó)人民銀行的財(cái)務(wù)收支和會(huì)計(jì)事務(wù)，應(yīng)當(dāng)執(zhí)行法律、行政法規(guī)和國(guó)家統(tǒng)一的財(cái)務(wù)會(huì)計(jì)制度，接受?chē)?guó)務(wù)院審計(jì)機(jī)關(guān)和財(cái)政部門(mén)依法分別進(jìn)行的審計(jì)和監(jiān)督。
Article 39 The financial receipts and payments and accounting affairs of The People's Bank of China shall be governed by laws, administrative rules and regulations and unified State financial and accounting systems and be subject to the auditing and supervision conducted, in accordance with law, separately by the audit institution and the financial department under the State Council.

第四十條 中國(guó)人民銀行應(yīng)當(dāng)于每一會(huì)計(jì)年度結(jié)束后的三個(gè)月內(nèi)，編制資產(chǎn)負(fù)債表、損益表和相關(guān)的財(cái)務(wù)會(huì)計(jì)報(bào)表，并編制年度報(bào)告，按照國(guó)家有關(guān)規(guī)定予以公布。
Article 40 The People's Bank of China shall, within three months after the end of every accounting year, compile balance sheets of its assets, statements of profit and loss and relevant financial and accounting reports, prepare its annual report and publish them in accordance with relevant regulations of the State.

中國(guó)人民銀行的會(huì)計(jì)年度自公歷１月１日起至１２月３１日止。
The fiscal year of The People's Bank of China begins on the first day of January and ends on the thirty-first day of December of the Gregorian calendar.

第四十一條 偽造人民幣、出售偽造的人民幣或者明知是偽造的人民幣而運(yùn)輸?shù)�，依法追究刑事�?zé)任。
Article 41 Anyone who counterfeits Renminbi or sells counterfeit Renminbi, or knowingly transports counterfeit Renminbi shall be investigated for criminal responsibility in accordance with law.

變?cè)烊嗣駧�、出售變�(cè)斓娜嗣駧呕蛘呙髦�是變�(cè)斓娜嗣駧哦�運(yùn)輸，構(gòu)成犯罪的，依法追究刑事責(zé)任；情節(jié)輕微的，由公安機(jī)關(guān)處十五日以下拘留、五千元以下罰款。
Anyone who alters Renminbi or sells altered Renminbi or knowingly transports altered Renminbi, if the cases constitutes a crime, shall be investigated for criminal responsibility; if the case is not serious, he shall be put by a public security organ in detention of not more than 15 days and imposed with a fine of not more than 5,000 yuan.

第四十二條 購(gòu)買(mǎi)偽造、變?cè)斓娜嗣駧呕蛘呙髦�是偽造、變�(cè)斓娜嗣駧哦�持有、使用，�?gòu)成犯罪的，依法追究刑事責(zé)任；情節(jié)輕微的，由公安機(jī)關(guān)處十五日以下拘留、五千元以下罰款。
Article 42 Anyone who buys counterfeit or altered Renminbi or knowingly holds or uses counterfeit or altered Renminbi, if the case constitutes a crime, shall be investigated for criminal responsibility; if the case is not serious, he shall be put by a public security organ in detention of not more than 15 days and imposed with a fine of not more than 5,000 yuan.

第四十三條 在宣傳品、出版物或者其他商品上非法使用人民幣圖樣的，中國(guó)人民銀行應(yīng)當(dāng)責(zé)令改正，并銷(xiāo)毀非法使用的人民幣圖樣，沒(méi)收違法所得，并處五萬(wàn)元以下罰款。
Article 43 If anyone illegally uses the patterns of Renminbi in propaganda materials, publications or other commodities, the People's Bank of China shall order him to set it right and shall destroy the illegally used patterns of Renminbi, confiscate the illegal gains and impose a fine of not more than 50,000 yuan.

第四十四條 印制、發(fā)售代幣票券，以代替人民幣在市場(chǎng)上流通的，中國(guó)人民銀行應(yīng)當(dāng)責(zé)令停止違法行為，并處二十萬(wàn)元以下罰款。
Article 44 If anyone prints or sells promissory notes as substitutes for Renminbi to circulate on the market, the People's Bank of China shall order him to cease his illegal act and impose a fine of not more than 200,000 yuan.

第四十五條 違反法律、行政法規(guī)有關(guān)金融監(jiān)督管理規(guī)定的，中國(guó)人民銀行應(yīng)當(dāng)責(zé)令停止違法行為，并依法給予行政處罰；構(gòu)成犯罪的，依法追究刑事責(zé)任。
Article 45 If anyone violates the provisions of laws or administrative rules and regulations concerning financial supervision and control, the People's Bank of China shall order him to cease his illegal act and impose on him administrative punishment in accordance with law; if the case constitutes a crime, he shall be investigated for criminal responsibility.

第四十六條 當(dāng)事人對(duì)行政處罰不服的，可以依照《中華人民共和國(guó)行政訴訟法》的規(guī)定提起行政訴訟。
Article 46 If any party refuses to accept the administrative punishment, he may institute an administrative lawsuit in accordance with the Administrative Procedure Law of the People's Bank of China.

第四十七條 中國(guó)人民銀行有下列行為之一的，對(duì)負(fù)有直接責(zé)任的主管人員和其他直接責(zé)任人員，依法給予行政處分；構(gòu)成犯罪的，依法追究刑事責(zé)任：
Article 47 If the People's Bank of China commits any of the following acts, the persons directly in charge and other persons directly responsible for the offense shall be subject to administrative sanctions according to law; if the case constitutes a crime, the offenders shall be investigated for criminal responsibility according to law:

（一）違反本法第二十九條第一款的規(guī)定提供貸款的；
(1)to provide a loan in violation of the provisions in the first paragraph of Article 29;

（二）對(duì)單位和個(gè)人提供擔(dān)保的；
(2)to provide guaranty for a unit or individual; or

（三）擅自動(dòng)用發(fā)行基金的。
(3)to use the issue fund without authorization.

有前款所列行為之一，造成損失的，負(fù)有直接責(zé)任的主管人員和其他直接責(zé)任人員應(yīng)當(dāng)承擔(dān)部分或者全部賠償責(zé)任。
If any of the acts specified in the preceding paragraph results in losses, the persons directly in charge and other persons directly responsible for the offense shall be partially or wholly liable for the losses.

第四十八條 地方政府、各級(jí)政府部門(mén)、社會(huì)團(tuán)體和個(gè)人強(qiáng)令中國(guó)人民銀行及其工作人員違反本法第二十九條的規(guī)定提供貸款或者擔(dān)保的，對(duì)負(fù)有直接責(zé)任的主管人員和其他直接責(zé)任人員，依法給予行政處分；構(gòu)成犯罪的，依法追究刑事責(zé)任；造成損失的，應(yīng)當(dāng)承擔(dān)部分或者全部賠償責(zé)任。
Article 48 If a local government or a government department at any level, a public organization or an individual forcibly demands the People's Bank of China or its staff member to provide a loan or a guaranty in violation of the provisions in Article 29, the persons directly in charge and other persons who are directly responsible for the offense shall be subject to administrative sanctions in accordance with the law; if the case constitutes a crime, the offenders shall be investigated for criminal responsibility according to law; if losses are caused, the offenders shall be partially or wholly liable for the losses.

第四十九條 中國(guó)人民銀行的工作人員泄露國(guó)家秘密，構(gòu)成犯罪的，依法追究刑事責(zé)任；情節(jié)輕微的，依法給予行政處分。
Article 49 If any staff member of the People's Bank of China divulges State secrets and if the case constitutes a crime, he shall be investigated for criminal responsibility according to law; if the case is not serious, he shall be subject to administrative sanction according to law.

第五十條 中國(guó)人民銀行的工作人員貪污受賄、徇私舞弊、濫用職權(quán)、玩忽職守，構(gòu)成犯罪的，依法追究刑事責(zé)任；情節(jié)輕微的，依法給予行政處分。
Article 50 If any staff member of the People's Bank of China commits embezzlement, accepts bribes, conducts malpractices for personal ends, abuses his power or neglects his duty and if the case constitutes a crime, he shall be investigated for criminal responsibility according to law; if the case is not serious, he shall be subject to administrative sanction according to law.

第五十一條 本法自公布之日起施行。
Article 51 This Law shall be effective on the date of promulgation.
